CONSULENZA TECNICA
Si tratta di una attività che rientra a pieno titolo “nell’ambito delle prestazioni d’opera intellettuali” e, per questo, risulta anch’essa caratterizzata “dall’assenza di subordinazione nei confronti del committente”. Rientrando nelle proprie competenze professionali, in altri termini, lo specialista esercita l’attività di consulenza in piena autonomia e sotto la propria responsabilità.
Nello specifico in caso di nomina da parte del Giudice in un procedimento Giudiziario di un Consulente di Ufficio all’atto della fissazione dell’udienza per il giuramento e la formulazione del quesito assegna anche alle parti un termine entro il quale possono nominare con dichiarazione ricevuta dal cancelliere un consulente tecnico di parte (art. 201 c.p.c.)
La nomina del CTP (Consulente Tecnico di Parte) è facoltativa ed è effettuata dal Procuratore in virtù del potere a quest’ultimo conferito dall’art. 84 c.p.c. .
Il sottoscritto è pertanto a disposizione, su territorio nazionale, con il proprio Know How e l’esperienza maturata come CTP e come CTU per l’assegnazione di incarichi specifici per Consulenze Tecniche.
Si rimette a chi fosse interessato la comunicazione delle diverse categorie a cui lo scrivente professionista è abilitato ed iscritto presso il competente Tribunale della provincia di Residenza.
TECHNICAL CONSULTING
This is an activity that fully falls within “the scope of intellectual work performance” and, for this reason, is also characterized “by the absence of law contracted subordination towards the client”. In other words, falling within their professional skills, the specialist carries out the consultancy activity in full autonomy and under his own responsibility.
Specifically, in the event of the appointment by the Judge in a judicial proceeding of an Office Consultant at the time of setting the hearing for the oath and the formulation of the “Question by the Judge”, he also assigns to the parties a term for them within which they can appoint with a declaration received from the Registrar a party technical consultant (Article 201 of the Code of Civil Procedure)
The appointment of the CTP (Party Technical Consultant) is optional and is carried out by the Attorney by virtue of the power conferred on the latter by art. 84 c.p.c. .
The undersigned is therefore available, on the national territory, with his know-how and experience gained as a CTP and as a CTU for the assignment of specific tasks for Technical Consultancy.
The communication of the different categories to which I am already professionaled authorized and registered at the competent Court of the province of Residence is left by me to those interested.
